National Minimum Wage
The National Minimum Wage Act of 1998 (NMWA) sets the minimum wages that firms are required to pay their employees. These rates are adjusted annually and vary depending on the worker’s age and working situation. The law mandates that workers receive a fair minimum wage to combat exploitation. Employers who fail to pay the minimum wage risk fines and legal repercussions.
Charlotte and Madeleine’s belief that all sales assistants should be paid the same regardless of age is commendable. However, it is essential to ensure that the pay rate complies with the current National Minimum Wage rates, which differ by age group. Paying all sales assistants £9.00 per hour may not comply with the minimum wage rates for all age groups, especially for younger workers.
Equal Pay
Under the Equality Act 2010, it is illegal to discriminate in compensation based on gender, age, disability, race, religion, or sexual orientation. In addition to ensuring compliance with the National Minimum Wage and equal pay laws, employers must also adhere to requirements related to pay statements. According to the Employment Rights Act 1996, employees have the right to receive a written itemized pay statement.

- Ensure that the pay rates for all sales assistants comply with the current National Minimum Wage rates for their respective age groups. This can be checked on the UK government’s official website or through legal counsel.
- Ensure that compensation decisions are based on objective criteria related to job duties, responsibilities, and performance, unrelated to any protected characteristics.
